Living From Within Partners

These Affiliate Terms & Conditions (“Agreement”) are a legal contract between you (“Affiliate”) and Lesley Pazdzioch and associated legal entities (“Company,” “we,” “us,” or “our”). By participating in the Living From Within Partners Affiliate Program (“Program”), you agree to abide by the following terms.

1. Definitions

Affiliate: An approved person or business who promotes our offerings for commission.
Commission: Earnings from verified purchases via the Affiliate’s referral link.
Qualified Sale: A non-refunded, completed purchase tracked to your link within 30 days.
Cookie Duration: 30 days (last-click attribution applies).
Tracking Link: Unique referral URL assigned to each Affiliate.

2. Commission Terms

Model: Pay-per-sale
Rate: 30% of Net Sales (excluding refunds, discounts, taxes, and fees)
Self-referrals: Not permitted
Chargebacks/Refunds: Will not generate commission

3. Payout Process

Frequency: Monthly, by the 15th of the following month
Minimum Threshold: USD 50
Payment Methods: PayPal, Direct Deposit (U.S.), Wise (International)
Tax Requirements:
– U.S. Affiliates: Submit W-9
– Non-U.S. Affiliates: Submit W-8BEN
If the payout minimum is not met, commissions roll over to the next cycle.

4. Marketing Rules

Allowed Promotional Methods:

Blog articles or program reviews
Personal email lists (with prior consent)
Organic social media posts
YouTube, podcast features, or webinars

Strictly Prohibited:

Spam, bots, or purchased email lists
Paid ads using our brand name or domain
False claims, impersonation, or misleading marketing
Promotion of adult, gambling, or hate-related websites

5. Use of Branding & Materials

You are granted a limited, revocable license to use our brand assets. You agree to:

Use only approved graphics/logos
Preserve brand integrity (no editing or misrepresentation)
Avoid using our trademarks in domain names, ad campaigns, or usernames.

All brand materials remain the property of the Company.

6. Exclusivity

This is a non-exclusive program. You may promote other services unless:

You sign a separate exclusive agreement

You promote direct competitors (which may be restricted)

7. Termination

You may terminate this agreement anytime with 7 days’ written notice.
We may terminate with or without cause with 7 days’ notice.

Immediate termination may occur due to:

Fraudulent or deceptive practices
Violation of these terms
Brand misuse or illegal conduct

Pending commissions may be forfeited if earned through policy violations.

8. Confidentiality

Affiliates must:

Keep all customer, business, and compensation data confidential
Never share internal tools, sales data, or strategies.
Continue honoring this for 5 years after termination.

9. Legal Compliance

You are responsible for ensuring:

FTC compliance: Disclose your affiliate relationship clearly
GDPR compliance: Only use opt-in consent-based marketing
CAN-SPAM / CASL: Include unsubscribe links and transparency in all email communications
Local laws: Follow promotional laws applicable in your location and your audience’s

10. Limitation of Liability

We are not liable for:

Lost earnings due to software issues or program changes
Tracking interruptions
Delays due to third-party processors or legal reviews

Your only remedy is to discontinue participation.

11. Dispute Resolution

All issues will first be handled through good-faith discussions.
If unresolved, binding arbitration will occur in the State of Colorado
Class action waivers apply.

12. Entire Agreement

This Agreement supersedes all prior discussions and constitutes the full agreement between you and the Company regarding the affiliate relationship.
